Can landlord barge apt timemr.lemonlime postedthe downstairs tenant has a leak and a over month ago we made a time for him to come in to look at and/or fix my shower. He never showed and told me not to use the shower just the bath. He told me she hasn't been getting any leaks and never made arrangements to fix anything. Now he knocks on my door Sunday at 130pm and says he needs to come in to fix it. I told him no. I am out of the house from 630am to 330pm M-F like we had arranged previously. Also I am on chemo and he is aware of this, as I have been on it for a while, He is aware I get very sick on the weekends Am I wrong? additional---------------------- The plumber he has with him does this as a side job. The laws of each state is different. In my state, the land lord is required to give 24 hrs written notice before entering an apt. to make repairs or inspections. The exception is when their is an emergency, like a broken pipe flooding the floors. No notice needed then, but you probably would want him over as quick as possible if that happened. reenzz repliedIf the downstairs tenant is still getting leaks from your shower/bath, then the landlord has every right to make the repair without notice nor your permission. Your failure to allow him to repair could result in two things.... 1. a lawsuit from the downstairs tenant and/or landlord for damages. 2. a notice to vacate for failing to allow the landlord to make necessary repairs. Especially since there was such a delay from the time it was first noted that it needed to be fixed. He has no right, unless it's an emergency, to come in unannounced. Wouldn't it be easier to just get it over with instead of postponing it to a time when, evidently, it isn't so convenient for this plumber?
