If they are in the US then yes, they are obligated to mail them to the past employees as the taxes for this have already been paid by this employee. If the check is returned in the mail (due to bad address) the they are required to try to notify the employee. All employment application forms have an "In Case of Emergency" address/phone number where they can locate the employee if they can no longer notify them at their normal number or address. Unless they are doing everyting possible to notify the past employee, they will be opening themselves up to a possible lawsuit by the Labor Board and State and/or Federal Tax Commissions.
